If you are a minor who has been charged with a crime or your juvenile child has been arrested, I can help. As a top San Diego juvenile crimes lawyer, I have defended hundreds of minors facing similar circumstances. I have successfully represented juveniles accused of drunk driving, reckless driving, weapons charges, assault, battery, arson, truancy, possession of alcohol, drug possession, drug sales, theft, vandalism, sex crimes as well as many other criminal offenses. I accept all major credit cards, offer free initial consultations and provide clients with reasonable, affordable rates, so if you find yourself in need of a San Diego juvenile crimes attorney, please call my office as soon as possible.
It is important to realize that criminal charges against minors are handled drastically different than those against adults. For example, there is no bail in juvenile courts, although minors may be released to their parents in many cases. Additionally, minors do not have the right to trial by jury, but instead will be convicted and sentenced exclusively by the judge hearing the case. For these reasons, you should only trust San Diego juvenile crimes lawyers who have ample experience in this complex arena of the California legal system.
Aside from the different procedures used in this court system, minors are also subject to different laws than most adults are. For example, age-related “status offenses,” such as truancy are only applicable against minors.
If the child is over 14 and the crime is a serious offense, then the court will hold a fitness hearing to determine whether or not the minor should be tried in the adult court system. In most cases, your San Diego juvenile lawyer will work to ensure the case is held in juvenile courts as sentencing generally is not as severe for minors. Of course, that’s not to say that sentencing in juvenile courts is not serious. When children under 16 are convicted, they may be incarcerated until they are 21 and if they are over 16, the length of their sentence may extend until they are 25.
When you hire me as your San Diego juvenile attorney, I will always work to have your child released under your custody rather than being sent to juvenile hall; I will collect any and all evidence available to support your child’s defense; I will make any available motions to help protect your child’s rights; I will fight to have the case stay in juvenile court rather than allowing the case to be transferred to the adult criminal system; I will fight to have the charges against your child reduced or dropped; and I will always present the best possible overall legal defense for the case.
